Below is an overview from the editor of our upcoming CCH Books release, Australian Fair Work Act 2009 with Regulations and Rules – 9th Edition.
The 9th edition includes the Fair Work Act, regulations and rules, as well as other relevant industrial legislation. It includes changes which have commenced since the last edition (1 August 2016) up to 20 September 2017.
The changes include provisions to:
- re-establish the Australian Building and Construction Commission
- establish a specialist Registered Organisation Commission
- resolve the Victoria’s Country Fire Authority (CFA) dispute
- increase the transparency and accountability of registered organisations
- increase the maximum penalties for serious offences by 10 times the penalty which would otherwise apply
- introduce liability for responsible franchisors and holding companies that have a significant degree of influence or control over their business networks
- create criminal offences for employer and employee registered organisations for giving, receiving or soliciting a corrupting benefit, and
- require employers and bargaining representatives for a proposed enterprise agreement to disclose financial benefits derived under a term of the proposed agreement.
The 9th edition also includes amendments which commenced very recently, such as the Fair Work Amendment (Corrupting Benefits) Act 2017, Fair Work Amendment (Protecting Vulnerable Workers) Act 2017, and amendments to the Code for the Tendering and Performance of Building Work 2016 to exempt essential services infrastructure.
The building and construction industry legislation in the previous edition has been repealed in its entirety and replaced by the new legislation below.
We have included the federal building code for the first time in this edition.
