Coal miners in NSW will now be eligible for greater death benefits under workers compensation legislation.
The Workers Compensation Amendment (Death Benefits) Regulation 2016 (the Amendment Regulation) inserts a savings and transitional provision into the Workers Compensation Regulation 2016 (NSW), which entitles coal miners to increased death benefits they were previously excluded from.
The lump sum compensation payable for the death of a worker was recently increased from $524,000 to $750,000, while the compensation payable in respect of the deceased worker’s funeral expenses was increased from $9,000 to $15,000. The increase applied if the death occurred on or after 5 August 2015, however, it did not apply to coal miners.
The Amendment Regulation commenced on 11 November 2016.
